In the united states I believe it's illegal to ask about the marital 
status of a job candidate.

According to about.com

in the U.S. it's illegal to ask about:

    * Race
    * Color
    * Sex
    * Religion
    * National origin
    * Birthplace
    * Age
    * Disability
    * Marital/family status
